The Texas Board of Criminal Justice (board) adopts amendments to §151.3, concerning Texas Board of Criminal Justice Operating Procedures without changes to the proposed text as published in the March 6, 2026, issue of the Texas Register (51 TexReg 1369). The rule will not be republished. The adopted amendments make minor grammatical updates.

No public comments were received regarding the amendments.

The amendments are adopted under Texas Government Code §§492.005-492.007, which establishes general duties for the board, §492.013, which authorizes the board to adopt rules; and Chapter 551, which establishes general provisions for open meetings.

SUBCHAPTER D. OTHER RULES

37 TAC §152.81

The Texas Board of Criminal Justice (board) adopts new rule §152.81, concerning Housing of Inmates without changes to the proposed text as published in the March 6, 2026, issue of the Texas Register (51 TexReg 1372). The rule will not be republished. The adopted rule states inmates shall be housed in compliance with state and federal law in accordance with Senate Bill 8, which was passed during the 89th Second Special Session and established Texas Government Code §3002.054.

No public comments were received regarding the new rule.

The new rule is adopted under Texas Government Code §3002.054, which establishes the requirement for inmates to be housed according to sex; and 28 C.F.R. Part 115, which establishes the Prison Rape Elimination Act.
